Online Privacy Policy

This Online Privacy Policy (this "Policy") explains how we collect, use, share, and protect information in connection with your use of the Platforms. Please read this Policy together with our Terms of Use. By using the Platforms, you acknowledge that you have read this Policy.
This Policy applies to this website and its interactive features, applications, social network pages, and microsites (the "Platforms"), which are operated by Fortis Lux Financial, Inc. ("Fortis Lux Financial") and its affiliated companies and sales representatives ("we," "us," or "our"). This Policy governs information collected through the Platforms. It does not govern information collected offline, information collected through channels other than the Platforms, or the privacy practices of any third party.
Securities, investment advisory and financial planning services are offered through qualified registered representatives of MML Investors Services, LLC, Member SIPC. MML Investors Services, LLC and its affiliates may maintain their own separate privacy notices, and those notices, rather than this Policy, govern the information they collect and the account-servicing activity they conduct, including activity conducted through account access portals reached from the Platforms. Those notices are available at MML Investors Services, LLC Privacy Notice. Where you access a third-party portal or platform through a link on the Platforms, including any insurance, eMoney, or Investor360 login, the privacy policy of the provider of that portal or platform applies to information you submit there. This Policy applies only to the Platforms operated by Fortis Lux Financial and does not govern the websites or services of those separate affiliated businesses.
We collect the following categories of information in connection with the Platforms.
Information you provide to us. When you complete a contact or inquiry form on the Platforms, we collect the information you submit, which currently consists of your first name, last name, email address, telephone number, and the content of your message, along with your acknowledgment of the applicable terms. We also collect information you provide when you correspond with us by email, telephone, or other means, or when you request information about products or services. The Platforms also make available meeting-scheduling tools, and when you request or schedule a meeting we collect the information you provide to arrange and manage it. The Platforms do not support document uploads, and you should not attempt to submit documents or files through them.
Information collected automatically. When you use the Platforms, we and our service providers may automatically collect certain information about your device and use of the Platforms, such as device and browser information, IP-derived information, referring and exit pages, pages viewed, interactions with the Platforms, and dates, times, and other usage information. We may use analytics technologies and service providers to help us understand how visitors use the Platforms, measure website performance, and improve the user experience. We may implement additional marketing technologies in the future.
Information from third parties. We may receive information about you from our affiliates, from our sales representatives, from service providers that support the Platforms, and from other sources where you have authorized the disclosure or where the information is publicly available.
We refer to information that identifies, relates to, or can reasonably be linked to an identified or identifiable individual as "Personal Information."
Please do not submit confidential or sensitive personal information, including account numbers, Social Security numbers, or health information, through a contact form or unencrypted email. As described in Section 7, information sent through the Internet is not secure.
We and our service providers may use cookies, pixels, tags, and similar technologies to operate the Platforms, remember preferences, understand how visitors use the Platforms, measure performance, and support our communications and marketing activities.
These technologies may include:
Necessary Technologies. Technologies required for the operation, security, and functionality of the Platforms.
Analytics Technologies. Technologies that help us understand how visitors interact with the Platforms and measure website usage and performance.
Marketing Technologies. Technologies that may be used to measure the effectiveness of our communications and marketing activities.
Where available or required by applicable law, you may manage certain non-essential cookies and similar technologies through the cookie preference controls available on our Platforms. You may also be able to control cookies through your browser settings. Disabling certain technologies may affect the functionality or performance of the Platforms.
Browser Privacy Signals. Some browsers and devices provide privacy preference or opt-out signals, such as Global Privacy Control. Where required by applicable law, we process recognized privacy preference signals in accordance with applicable requirements.
We use the information described in Section 2 for the following purposes: to respond to your inquiries and requests and to contact you about them; to provide, administer, and improve the Platforms and the products and services described on them; to communicate with you about products, services, events, and other information that may interest you, subject to your marketing choices under Section 9; to analyze how visitors use the Platforms and to measure and improve their performance; to maintain the security and integrity of the Platforms, to detect and prevent fraud and unauthorized access, and to protect our rights and the rights of others; and to comply with applicable law, regulation, and the recordkeeping, supervisory, and reporting obligations that apply to our business and to the registered representatives associated with it.
Personal Information collected through the Platforms is not currently used for any purpose beyond those described above. We do not currently use Personal Information collected through the Platforms for targeted advertising or automated decision-making.
We may share Personal Information as follows: with our affiliated companies and with the sales representatives and financial professionals associated with us, so they may respond to your inquiry and service your relationship; with MML Investors Services, LLC and its affiliates where the information relates to securities, investment advisory, or financial planning services offered through its registered representatives, in which case their privacy notices apply to that information as described in Section 1; with service providers that perform functions on our behalf, such as website hosting, technology support, analytics, communications, and marketing services, which are permitted to use the information only to perform those functions for us; in connection with a merger, acquisition, financing, reorganization, or sale of assets, or in connection with a similar transaction or proceeding; and when required or permitted by law, including in response to subpoenas, court orders, regulatory or self-regulatory requests, and examinations, and where necessary to establish or defend legal claims, to enforce our Terms of Use, or to protect the rights, property, or safety of any person.
We do not sell Personal Information collected through the Platforms. We are not aware of any disclosure of Personal Information collected through the Platforms to a third party in exchange for monetary or other valuable consideration. We may disclose Personal Information to service providers that perform services on our behalf, such as website hosting, technology support, analytics, communications, scheduling, security, and marketing services.
The Platforms contain links to websites operated by others, provided as a convenience to visitors. When you click on such a link, you leave the Platforms. The existence of a link does not indicate that we endorse the linked site. Unless otherwise indicated, linked sites are not under our control or the control of our affiliated companies, and we are not responsible for their content or for their privacy or security practices. The operators of those sites may collect information about you through cookies or other web technologies, and we have no control over that collection. We recommend that you review the privacy, security, and terms of use policies of any linked website you visit.
We maintain reasonable administrative, technical, and physical safeguards designed to protect Personal Information against loss, misuse, and unauthorized access, disclosure, alteration, and destruction. No safeguard is absolute. In general, information sent through the Internet is not secure, and email services provided through the Platforms generally are not encrypted and do not provide a secure and private means of communication with us. We cannot guarantee that information transmitted through the Internet is secure, or that such transmissions will be free from delay, interruption, interception, or error. Confidential and personal information should be communicated to us only when you are advised that you are using a secure mechanism. We do not request or collect sensitive personal information through our public websites or website forms, such as Social Security numbers, dates of birth, financial account information, or similar confidential financial information. Our website forms are intended for general inquiries and basic contact information only, and you should not submit sensitive or confidential information through them.
We retain Personal Information for as long as necessary to fulfill the purposes described in this Policy, and for any longer period required by applicable law or by the recordkeeping and supervisory requirements that apply to our business. When information is no longer needed for those purposes, we take reasonable steps to delete it or render it no longer identifiable. These requirements include applicable broker-dealer and investment adviser recordkeeping requirements. We do not maintain a separate fixed retention period specifically for information collected through the public Platforms; website inquiries and related information are retained only as long as necessary for the business purpose for which they were collected and in accordance with applicable recordkeeping requirements.
You may opt out of marketing communications from us at any time by following the unsubscribe instructions in the communication or by contacting us using the information in Section 14. Even if you opt out of marketing communications, we may continue to send you communications relating to an inquiry you submitted, a transaction you requested, or a relationship you maintain with us, and communications required by law.
You may also contact us to request that we correct or update the information you have provided through the Platforms.
For purposes of state-specific privacy rights under this Policy, we apply the law of the State of New York. New York has not enacted a comprehensive consumer privacy law granting website users a statutory right to access, correct, or delete personal information held by a private business. New York's data-security statute, the Stop Hacks and Improve Electronic Data Security Act (General Business Law sections 899-aa and 899-bb), requires us to notify affected New York residents of certain data breaches and to maintain reasonable safeguards, and it is enforced by the New York Attorney General rather than through individual consumer rights. As a matter of our own policy, and regardless of your state of residence, you may ask us to access, correct, update, or delete the information you provided through the Platforms by contacting us using the information in Section 14, and we will respond consistent with applicable law. If you reside in a state whose law grants you additional privacy rights, we will honor those rights as that law requires.
The Platforms are not directed to children under 13, and we do not knowingly collect Personal Information from children under 13 through the Platforms. As stated in our Terms of Use, to use the Platforms you must be 18 or older, or be 13 or older and have your parent or guardian's consent. If you believe a child under 13 has provided Personal Information through the Platforms, please contact us using the information in Section 14, and we will take appropriate steps to delete it.
Separate privacy notices may be required in connection with financial products and services, including notices required by the Gramm-Leach-Bliley Act and Regulation S-P. Where such a notice applies to you, it is provided separately in connection with the applicable product, service, or account relationship, and that notice, rather than this Policy, governs the nonpublic personal information covered by it. Nothing in this Policy limits, replaces, or modifies any such notice. For securities, investment advisory, and financial planning relationships conducted through MML Investors Services, LLC (MMLIS), the applicable financial privacy notice is provided by MMLIS. Fortis Lux Financial operates as a MassMutual general agency, and our financial professionals who provide securities, investment advisory, or financial planning services do so through MMLIS. We may revise and update this Policy from time to time. If we make any material changes, we will post a notice on the Platforms prior to the change becoming effective. The date at the top of this Policy indicates when it was last updated. By continuing to use the Platforms, you agree to any changes or updates.
The laws of the State of New York will govern any claims relating to this Policy and to information collected through the Platforms, without giving effect to any choice or conflict of law provision or rule. The jurisdiction and forum provisions of our Terms of Use apply to any action relating to this Policy.
